Website, Funnel and Content Terms and Conditions

These Terms govern access to our public online services.

Paid consultancy is governed by a separate written agreement, which takes priority for that engagement.

1. About us and these Terms

These Terms apply to nobacklog.co.uk, associated landing and funnel pages, forms, Fit Calls, free resources, webinars, and our official YouTube and social-media content (the Services). The Services are operated by Descartes Consulting Limited, registered in Scotland under company number SC787331, with registered office at The Old Station Cowdenburn, Lamancha, West Linton, Borders, Scotland, EH46 7BD. By using the Services, you agree to these Terms. Do not use them if you do not agree.

2. Nature of the Services

We provide business-to-business management consultancy and operational-improvement services. Public content may discuss operational backlogs, workflow, claims and pension administration, service levels, process improvement, workshops and related topics. It is principally intended for organisations, management teams and professionals.

Public content and free resources are general business and educational information. They are not legal, financial, investment, regulated pension, pension-transfer, tax, actuarial, individual-claim or other regulated professional advice. We do not represent individual claimants, policyholders or pension members through the Services.

3. No engagement through public contact

Visiting, viewing, commenting, subscribing, downloading, submitting a form, receiving an email, booking or attending a Fit Call, or communicating through social media does not create a consulting relationship or oblige us to accept work. An engagement starts only after appropriate enquiries, agreement of scope and commercial terms, and signature of a written agreement.

4. Eligibility, authority and information you submit

You must be at least 18 to submit a form or make a booking. If you act for an organisation, you confirm that you have authority to make the enquiry, provide the relevant business information and discuss a possible engagement.

Information you provide must be accurate, current, relevant, not misleading and supplied with appropriate authority. Do not provide another person's information unless you have a lawful basis and authority.

Public forms, booking services, comments and messages must not be used to submit personal claim files, medical or health information, pension-member information, government identifiers, identity documents, bank or card details, credentials, legally privileged material or other sensitive or confidential personal records. If such information is needed for an accepted engagement, we will agree a secure process.

5. Fit Calls, bookings and free resources

A Fit Call is an introductory business conversation to understand general circumstances, assess possible relevance and decide whether further discussion is appropriate. It is not a consulting engagement, complete operational assessment, promise to accept work, regulated advice or guarantee of results.

Bookings are subject to availability and confirmation. We may reasonably reschedule, cancel, refuse or end a call where the enquiry is outside our work, information is materially inaccurate, the booking appears abusive or automated, conduct is inappropriate, or continuing would create a legal, ethical, security or commercial concern.

Free books, guides, videos, webinars, templates and similar resources are supplied for general education and internal organisational use unless stated otherwise. A free resource requires no payment and requesting it does not automatically authorise unrelated marketing.

6. Intellectual property and permitted use

The Services and their content are owned by or licensed to us. You may view them, share an ordinary link, use authorised platform sharing or embedding, and print or download reasonable extracts for lawful personal or internal business use.

Without written permission, you must not sell, license, commercially redistribute or republish substantial content; remove attribution; present it as your work; make misleading edits; imply endorsement; use it to provide a competing commercial product or service; or use it to train or develop a commercial artificial-intelligence model, except where applicable law permits the activity and cannot lawfully be excluded.

7. YouTube, social media, sponsorships and affiliates

Platform use is also governed by the platform's terms. Our channel or content may earn revenue through platform advertising, subscriptions, memberships, audience-support features, sponsorships, paid product placements, affiliate links and similar tools. Platform-selected advertising does not mean we endorse every advertiser.

Where required, we disclose a material commercial relationship. Sponsored or affiliate content reflects the views stated at publication but is not a guarantee concerning a third party, whose own terms, privacy policy, pricing, warranties and support arrangements apply.

8. Comments and acceptable use

You must use the Services lawfully. You must not publish confidential or sensitive information; defame, threaten, harass or discriminate; impersonate; post unlawful, fraudulent or misleading material; spam; infringe intellectual-property, privacy or confidentiality rights; distribute harmful code; use automated tools to submit forms or bookings; scrape personal information; attempt unauthorised access; disrupt security; or help another person do so.

We may remove, hide or report contributions and restrict access where reasonably necessary. We are not obliged to monitor every contribution. Independent users' opinions are their own.

9. Accuracy, results and guarantees

We take reasonable care but do not guarantee that public content is complete, current, error-free, suitable for a particular organisation or applicable in every jurisdiction. You are responsible for evaluation and appropriate advice.

Case studies, testimonials, targets, estimates and performance statements relate to particular circumstances or are illustrative. They do not guarantee or predict another organisation's result. A target is an objective, not a guaranteed outcome. We retain evidence that testimonials are genuine and evidence supporting objective advertising claims.

Any workshop guarantee is subject to the scope, client preparation, participation, information supplied, exclusions and remedy in the signed engagement agreement. Unless that agreement says otherwise, it concerns agreed workshop outputs and not a particular backlog reduction, financial saving, staffing reduction, implementation result or timeframe.

10. External services, availability and security

The Services may link to or integrate with Calendly, YouTube, Meta, LinkedIn, Google, video, webinar, email, CRM and other independent providers. We do not control their availability, security, content, terms or independent processing. A link does not necessarily constitute endorsement.

We do not guarantee uninterrupted, secure or error-free availability or compatibility with every device. We may suspend, restrict, withdraw or change the Services. You are responsible for protecting your devices, systems and data.

11. Liability

Nothing in these Terms excludes or limits liability where that would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or another liability that cannot legally be excluded.

Subject to that restriction, we are not responsible for loss arising solely from reliance on general public content without appropriate advice, inaccurate information supplied by a user, acts or omissions of an independent third party, failure to implement information appropriately, interruption or withdrawal, malicious code introduced by another person, or events outside our reasonable control.

For business users, to the fullest extent permitted by law, we are not liable in connection with free public content for lost profit, revenue, business, opportunity, anticipated savings, goodwill or data, or for indirect or consequential loss. Liability for an accepted engagement is governed by its written agreement.

12. Privacy, communications and changes

Our Privacy Policy explains our use of personal information, and our Cookie Policy and Cookie Settings explain storage and access technologies. Submitting an enquiry, arranging a call or requesting a resource authorises communications reasonably necessary to respond, administer the request or discuss a possible engagement; it does not automatically authorise unrelated marketing.

We may update these Terms for changes in services, business practices, technology or law. The revised version applies from publication and does not retrospectively alter a signed consulting agreement.

13. General legal terms

If a provision is unlawful, invalid or unenforceable, it will be modified to the minimum extent necessary or deleted, and the rest will continue. A delay in enforcement is not a waiver. Unless expressly stated otherwise, a person who is not a party has no right to enforce these Terms.

14. Governing law and contact

These Terms and related non-contractual disputes are governed by Scots law. For business users, the Scottish courts have exclusive jurisdiction. A consumer may retain mandatory laws and court protections that apply where they ordinarily live; nothing removes a protection that applicable law does not permit them to waive.
